Refund & withdrawal

This page sets out your right of withdrawal, how to exercise it, what happens when work has already begun, and how refunds are calculated and paid. It reflects articles L221-18 to L221-28 of the Code de la consommation and Directive 2011/83/EU, and forms part of the terms and conditions.

1. Who this applies to

The statutory right of withdrawal described in sections 2 to 8 applies to consumers — natural persons acting outside their trade, business, craft or profession — buying at a distance. It also applies to a professional employing five or fewer staff where the service ordered falls outside their main field of activity, in accordance with article L221-3. Other professional clients are covered by section 10.

2. Your right of withdrawal

You have 14 calendar days to withdraw from the contract without giving a reason and without incurring any cost other than those described in section 5. The period runs from the day after the contract is concluded, which is the day the order confirmation is sent. If it would end on a Saturday, Sunday or public holiday, it runs to the end of the next working day.

3. Why the checkout asks you to confirm two things

Services here usually begin well inside the 14-day period, because that is the point of buying them. Article L221-25 permits performance to start during the withdrawal period only where the consumer has made an express request, and requires the consumer to be informed that the right of withdrawal is lost once the service has been fully performed.

That is exactly what the checkbox at checkout does. Ticking it is your express request to begin, and records your acknowledgement of the consequence. The confirmation is stored against your order with a timestamp, and repeated in your order confirmation email.

You are free not to tick it. In that case work does not begin until the 14 days have elapsed, and the delivery window starts from the end of that period.

4. Instant downloads

For digital content supplied on a durable medium other than a physical one — the template packs on this site — the right of withdrawal does not apply once performance has begun, provided you gave your prior express consent and acknowledged that you would lose that right, in accordance with article L221-28 13°. Checkout obtains both before the download link is released. Until you begin downloading, you may withdraw and receive a full refund.

5. Withdrawing once work has started

If you asked for work to begin and the service has not been fully performed, you may still withdraw within the 14 days. You then pay an amount proportionate to what has actually been supplied up to the moment your withdrawal was communicated, measured against the total price of the contract. The calculation is shown to you in writing.

If the service has been fully performed within the 14 days, having begun at your express request and with your acknowledgement, the right of withdrawal no longer applies. Your rights in respect of non-conforming work under section 9 are unaffected.

If you did not ask for work to begin early, and none has begun, you receive a full refund.

6. How to withdraw

Send an unambiguous statement before the deadline expires. Email info@codingbynadezda.online, or telephone +48 732 145 104 and follow it up in writing so that a record exists. Postal notice may be sent to Balujeva Nadezda — Entrepreneur Individuel (EI), 25 Rue Gustave Eiffel, 34070 Montpellier, France. Sending the statement before the deadline is sufficient; it does not matter if it arrives the following day. The burden of proving that withdrawal was exercised in accordance with this section rests with you, which is why writing is preferable.

Receipt of any withdrawal is acknowledged on a durable medium without delay, normally the same or the next working day, confirming what has been supplied and what will be refunded.

7. Refunds: method and timing

All sums received are refunded, less any proportionate amount due under section 5, without undue delay and no later than 14 days from the day the withdrawal is notified. Refunds are made using the same means of payment you used, unless you expressly agree otherwise, and no fee is charged for making them. Where your bank applies its own conversion or handling charge on the return, that charge is a matter between you and your bank.

Where a refund is late, article L242-4 provides for the sum due to be increased at the rates set out there.

8. Cancellation before work begins

Outside the statutory right of withdrawal, any order may be cancelled before work has begun, for a full refund, simply by writing to info@codingbynadezda.online.

9. If the work does not conform

Separately from any right of withdrawal, services must be performed with reasonable care and skill and in conformity with their description. Consumers benefit from the statutory guarantee of conformity for digital content and services under articles L224-25-12 and following of the Code de la consommation.

If a deliverable does not conform, say so. It will be brought into conformity at no cost and within a reasonable time. Where that is impossible or cannot be done without significant inconvenience to you, you may obtain an appropriate reduction in price or, where the lack of conformity is not minor, the resolution of the contract and a refund. These are statutory rights and nothing on this page limits them.

10. Professional clients

Professional clients outside the scope of section 1 have no statutory right of withdrawal. An order may be cancelled before work begins for a full refund. Once work has begun, you pay for what has been delivered and for work irrevocably committed, and the balance is refunded. Questions of quality are dealt with under clause 11 of the terms and conditions.

11. If a delivery window is missed

Where a stated delivery window is missed for a reason on the provider’s side, you may require performance within a reasonable additional period. If that period also passes without performance, you may terminate the contract by writing to info@codingbynadezda.online, and all sums paid for the part not performed are refunded no later than 14 days after termination, in accordance with articles L216-6 and L216-7.

12. Chargebacks

If you believe a payment is wrong, please make contact before instructing your bank; direct resolution is almost always faster. Where a chargeback is raised in respect of a service delivered in accordance with the contract, the order record, the timestamped immediate-start confirmation and the delivery evidence are provided to the payment provider.

13. Complaints and mediation

Complaints go to info@codingbynadezda.online or +48 732 145 104. Receipt is acknowledged within one working day and a written answer follows within five working days, or an explanation with a date no later than twenty working days from first contact. If the answer does not satisfy you, consumers may refer the matter to the consumer mediator — see the consumer mediation page. Your right to go to court is unaffected.
